A jury convicted appellant, Frabon Crocker, of aggravated robbery, and, having pleaded true to two enhancement allegations, he was sentenced to 35 years confinement. Tex. Pen. Code Ann. § 29.03 (Vernon 2003). In four issues, appellant complains that (1) the pre-trial identification procedures used by the Houston Police Department were impermissibly suggestive, (2) "the trial court erred in overruling [his] objection to the prosecutors comment on [ ] appellants failure to testify," (3) the trial court improperly defined the standard of proof during voir dire, and (4) he received ineffective assistance of counsel. We reverse and remand for a new trial.
