1 This action was brought by C.I. Dodson, hereinafter referred to as plaintiff, against Dewey A. Croft, hereinafter referred to as defendant, to recover damages for personal injuries alleged to have been sustained by plaintiff as a result of an automobile accident which occurred on the Turner Turnpike on September 25, 1953, at which time plaintiff was a passenger in an automobile driven by defendant. Upon trial of the case, the jury returned a unanimous verdict for the defendant. Plaintiff thereupon filed a motion for a new trial upon the sole stated ground that the verdict was contrary to and not supported by the evidence. The trial court sustained plaintiffs motion for new trial and defendant has perfected this appeal therefrom.
